Navigate Charlotte Rental Laws

Summary Ejectment (Eviction)

NC uses "Summary Ejectment" for evictions. You must give 10 days notice for non-payment before filing in Small Claims Court.

Security Deposit Trust Accounts

Deposits must be held in a trust account in a licensed bank. You must notify the tenant of the bank name and address within 30 days.

Deposit Return Timeline

Return deposits within 30 days of lease end. Can be extended to 60 days with an interim estimate if damages are hard to calculate.

Late Fee Limits

Late fees are capped at $15 or 5% of rent, whichever is greater. Can only be charged if rent is 5 days late.

Fit and Habitable Premises

Landlords must keep premises fit and habitable, including working smoke and CO detectors. No "repair and deduct" right for tenants in NC.

Victim Protection

Tenants who are victims of domestic violence, sexual assault, or stalking have special rights to terminate leases early.
