Terms of Service

Welcome to RentMouse. These Terms of Service ("Terms") govern your access to and use of the RentMouse platform, website, and services (collectively, the "Service"). By accessing or using RentMouse, you agree to be bound by these Terms.

1. Acceptance of Terms

1.1 Binding Agreement

By creating an account, accessing, or using RentMouse, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you are using RentMouse on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

1.2 Eligibility

You must be at least 18 years old and capable of forming a binding contract to use RentMouse. By using our Service, you represent that you meet these requirements.

1.3 Changes to Terms

We may modify these Terms at any time. We will notify you of material changes via email or through the Service. Your continued use of RentMouse after changes take effect constitutes acceptance of the modified Terms.

2. Service Description

RentMouse provides a cloud-based property management platform that includes:

  • Property and unit management
  • Tenant applications and screening
  • Lease creation and digital signatures
  • Rent collection and payment processing
  • Maintenance request management
  • Tenant communications and portal access
  • Financial reporting and analytics
  • Document storage and management

3. Account Registration and Security

3.1 Account Creation

To use RentMouse, you must create an account by providing accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

3.2 Account Security

You agree to:

  • Maintain the security of your password and account
  • Notify us immediately of any unauthorized use or security breach
  • Not share your account credentials with others
  • Not create multiple accounts for the same organization

3.3 Organization Accounts

Organization accounts are created with a unique organization identifier. All users within an organization share access to that organization's data according to their assigned roles and permissions.

4. Fees, Payments, and Founding Member Program

4.1 Fee Structure

RentMouse charges two types of fees for payment processing services:

  • Platform Fee: RentMouse's service fee for facilitating rent payments and providing the platform
  • Processing Fee: Third-party payment processor fees (Stripe/Plaid) passed through at cost with no markup

4.2 Fee Phases

RentMouse operates in distinct fee phases:

  • Acquisition Mode: 0% platform fees; only processing fees at cost apply
  • Standard Mode: Volume-based platform fees ranging from 0.25% to 0.5% based on portfolio size

4.3 Founding Member Program

Eligibility: Organizations that create accounts before January 1, 2026, 11:59 PM UTC automatically qualify as "Founding Members."

Benefits: Founding Members receive:

  • Platform fee locked at 0.25% (best tier) for the lifetime of their account
  • Protection from future fee increases
  • Rate guarantee regardless of portfolio size or future pricing changes
  • Special founding member badge and recognition

Determination: Founding Member status is automatically determined based on the organization's creation date in our system. This status cannot be transferred or shared between organizations.

4.4 Volume-Based Pricing (Standard Mode)

When in Standard Mode, non-Founding Member accounts pay platform fees based on portfolio size:

  • 0-9 units: 0.5% platform fee (min $1.00, max $8.00 per transaction)
  • 10-49 units: 0.35% platform fee (min $0.75, max $6.00 per transaction)
  • 50+ units: 0.25% platform fee (min $0.50, max $5.00 per transaction)
  • Founding Members: 0.25% platform fee regardless of portfolio size

4.5 Processing Fees

Processing fees are charged at cost with no markup:

  • ACH/Bank Transfer: 0.8% capped at $5.00 per transaction
  • Credit/Debit Card: 2.9% + $0.30 per transaction

4.6 Fee Collection

All fees are collected automatically from payment transactions. Fees are clearly disclosed to tenants before payment completion. You agree to the fee structure applicable to your account type and phase.

4.7 Fee Changes

We reserve the right to modify our fee structure with 30 days' notice. Founding Members are exempt from platform fee increases and will maintain their 0.25% rate indefinitely. Processing fees may change based on our payment processor's rates.

4.8 Payment Processing

Payment processing services are provided through third-party processors (Stripe and Plaid). By using our payment features, you agree to their respective terms of service. We are not responsible for errors or failures by payment processors.

5. Acceptable Use

5.1 Permitted Use

You may use RentMouse solely for lawful property management purposes in compliance with all applicable laws and regulations.

5.2 Prohibited Activities

You agree not to:

  • Use the Service for any illegal or unauthorized purpose
  • Violate fair housing laws or discriminate against protected classes
  • Attempt to gain unauthorized access to the Service or other accounts
  • Interfere with or disrupt the Service or servers
  • Use automated systems (bots, scrapers) without written permission
  • Reverse engineer, decompile, or attempt to extract source code
  • Resell or redistribute the Service without authorization
  • Upload malicious code, viruses, or harmful content
  • Harass, abuse, or harm other users
  • Misrepresent your identity or affiliation

5.3 Compliance with Laws

You are responsible for complying with all applicable local, state, and federal laws, including but not limited to:

  • Fair Housing Act and state/local fair housing laws
  • Fair Credit Reporting Act (FCRA) for tenant screening
  • Americans with Disabilities Act (ADA)
  • State and local landlord-tenant laws
  • Privacy and data protection regulations
  • Tax reporting and compliance requirements

6. Data Ownership and Usage

6.1 Your Data

You retain all ownership rights to the data you upload, create, or store in RentMouse ("Your Data"). You grant us a limited license to use, store, and process Your Data solely to provide the Service.

6.2 Our Rights

We reserve the right to:

  • Use aggregated, anonymized data for analytics and service improvements
  • Display Your Data to authorized users within your organization
  • Access Your Data to provide support or investigate violations
  • Retain backups for disaster recovery purposes

6.3 Data Accuracy

You are responsible for the accuracy and legality of Your Data. We are not responsible for errors, omissions, or illegal content you upload.

7. Intellectual Property

7.1 RentMouse Property

RentMouse, its logo, features, and functionality are owned by us and protected by copyright, trademark, and other intellectual property laws. You may not use our trademarks without prior written permission.

7.2 Feedback

If you provide feedback, suggestions, or ideas about RentMouse, we may use them without obligation or compensation to you.

8. Third-Party Services

RentMouse integrates with third-party services including:

  • Stripe: Payment processing and Connect accounts
  • Plaid: Bank account verification and ACH transfers
  • Google Firebase: Database, authentication, and hosting
  • Credit Bureaus: Tenant screening and background checks

Your use of these services is subject to their respective terms. We are not responsible for third-party service failures, errors, or changes.

9. Termination

9.1 Termination by You

You may terminate your account at any time through account settings or by contacting support. Upon termination, you will have 30 days to export your data before it is deleted.

9.2 Termination by Us

We may suspend or terminate your account immediately if you:

  • Violate these Terms
  • Engage in fraudulent or illegal activity
  • Fail to pay required fees
  • Create security risks
  • Harm other users or our reputation

9.3 Effect of Termination

Upon termination:

  • Your access to the Service will cease
  • We will provide a data export if technically feasible
  • Your Data will be deleted according to our retention policies
  • Sections of these Terms that should survive termination will remain in effect
  • Founding Member status terminates with the account and cannot be restored

10. Disclaimers and Limitations of Liability

10.1 Service "As Is"

RentMouse is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

10.2 No Legal or Financial Advice

RentMouse does not provide legal, financial, or tax advice. Lease templates and other content are for informational purposes only. Consult licensed professionals for legal and financial guidance.

10.3 Limitation of Liability

To the maximum extent permitted by law:

  • Our total liability is limited to the amount you paid us in the 12 months preceding the claim
  • We are not liable for indirect, incidental, consequential, or punitive damages
  • We are not liable for data loss if you failed to maintain backups
  • We are not liable for third-party service failures or errors

11. Indemnification

You agree to indemnify and hold harmless RentMouse, its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorney fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any laws or regulations
  • Your violation of any third-party rights
  • Your Data or content you upload

12. Dispute Resolution

12.1 Informal Resolution

Before filing a claim, you agree to contact us at legal@rentmouse.com to attempt informal resolution.

12.2 Governing Law

These Terms are governed by the laws of the jurisdiction where RentMouse is incorporated, without regard to conflict of law principles.

12.3 Arbitration

Any disputes will be resolved through binding arbitration in accordance with applicable arbitration rules, except that you may bring claims in small claims court if eligible.

13. General Provisions

13.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and RentMouse.

13.2 Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions will continue in full force and effect.

13.3 No Waiver

Our failure to enforce any right or provision does not constitute a waiver of that right or provision.

13.4 Assignment

You may not assign or transfer these Terms without our written consent. We may assign these Terms without restriction.

13.5 Force Majeure

We are not liable for delays or failures due to causes beyond our reasonable control, including acts of God, natural disasters, war, terrorism, labor disputes, or government actions.

Note: By using RentMouse, you acknowledge that you have read and understood these Terms of Service. If you are a Founding Member, your 0.25% platform fee rate is contractually guaranteed and will not increase.
